That ties in with Nathan Newman's totally-underappreciated observation a few years back that court "victories" have turned out to be pretty hollow.

However, as per the "libertarian" root of liberal I don't know how much democracy was actually intended by the Founding Fathers, the tyranny of the majority and all that.

I think, imagining the American electorate today without Constitutional safegard, that you personally as a "Marxist college professor" would see a law passed saying you could be one or the other, but not both. I recently watched a horrifying hearing on Pennsylvania's HR 177 where the Republicans pretended they never heard of David Horowitz and they came up with this idea to form an "Un American College Professor Activities Committee" all by themselves.
